API Service Terms

The legal terms that govern ClearCrowds API, CLI, Agent Skill, MCP, API keys, jobs, outputs, and API Credits.

These ClearCrowds API Service Terms (the “API Terms”) form a binding agreement between you or the organization you represent (“Customer”) and the ClearCrowds service operator identified in the applicable checkout, order record, or invoice (“ClearCrowds,” “we,” “us,” or “our”). They govern access to and use of the ClearCrowds API, Developer Hub, console, CLI, Agent Skill, MCP integrations, SDKs, API keys, models, jobs, outputs, and API Credits (collectively, the “API Services”).

By creating or using an API key, authorizing a CLI or Agent, submitting a job, or purchasing API Credits, Customer accepts these API Terms and the ClearCrowds Acceptable Use Policy. If you accept for an organization, you represent that you have authority to bind it. If you do not agree, do not use the API Services.

1. Accounts, projects, and credentials

Customer must provide accurate account and billing information, protect API keys and access tokens, use the minimum scopes required, and promptly revoke credentials that may be compromised. Customer is responsible for activity performed with its credentials and for configuring its applications, Agents, contractors, and end users securely.

Customer must not share credentials publicly, place them in client-side code, evade rate or usage limits, probe or disrupt the API Services, bypass safeguards, or use the API Services to build or operate a competing unauthorized resale or proxy service.

2. Customer content and permissions

Customer retains its rights in images, prompts, instructions, metadata, and other material it submits (“Customer Content”). Customer grants ClearCrowds and its subprocessors a limited, worldwide right to host, transmit, reproduce, analyze, transform, and process Customer Content only as reasonably needed to provide, secure, troubleshoot, and improve the requested API Services, prevent abuse, and comply with law.

Customer represents and warrants that it has every copyright, privacy, publicity, portrait, likeness, biometric, contractual, and other right, permission, notice, and consent required to submit and process Customer Content and to use, publish, or distribute each output. Where a depicted person’s consent is required, Customer must obtain valid consent before submission and preserve evidence of that consent.

3. Prohibited content and conduct

Customer must not use, attempt to use, or enable anyone to use the API Services to create, upload, edit, transform, enhance, restore, distribute, or otherwise facilitate:

  • content or conduct that is illegal, fraudulent, deceptive, defamatory, harassing, threatening, hateful, exploitative, or that facilitates crime, evasion, extortion, impersonation, surveillance, or harm;
  • child sexual abuse material, sexualization or exploitation of minors, non-consensual intimate imagery, nudity, pornography, explicit or sexually suggestive content, sexual violence, or adult entertainment;
  • terrorism, violent extremism, graphic violence, self-harm, weapons abuse, or instructions intended to cause physical, financial, psychological, or societal harm;
  • face swaps, deepfakes, identity manipulation, fabricated evidence, or depictions that falsely suggest a real person’s identity, consent, endorsement, location, statement, conduct, or participation in an event;
  • content that infringes copyright, trademark, privacy, publicity, portrait, likeness, personality, moral, or other rights of any person or organization; or
  • removal, concealment, alteration, or circumvention of provenance, authenticity, safety, access-control, watermark, disclosure, or AI-generated-content labels required by ClearCrowds or applicable law.

These prohibitions apply to the entire workflow, including inputs, instructions, intermediate results, outputs, publication, distribution, and downstream use. A technically successful response does not mean that ClearCrowds approves the content or confirms that it is lawful, accurate, non-infringing, or fit for Customer’s purpose.

4. Government documents, credentials, and official records

Customer must not use the API Services to create, modify, forge, counterfeit, simulate, reproduce, authenticate, clean up, restore, enhance, redact, or remove or replace information in any government-issued or official document, credential, record, seal, symbol, or authentication feature. This includes passports, visas, identity cards, residence permits, driver licenses, birth or death certificates, permits, professional licenses, tax or immigration records, police or court records, ballots, currency, official certificates, evidence, and documents that appear to have been issued or endorsed by a government, court, regulator, school, bank, employer, or other authority.

Customer also must not use an output as evidence, proof of identity, proof of eligibility, an official filing, a compliance record, or a substitute for an authentic document.

5. Political and civic influence

Customer must not use the API Services for political campaigning, electioneering, voter persuasion or suppression, referendum advocacy, lobbying, political fundraising, propaganda, or any other purpose intended to influence political or civic opinion, participation, or outcomes.

Customer must not create or manipulate a depiction of a candidate, public official, political party, election, protest, armed conflict, public emergency, government action, or other matter of public concern in a way that is false, misleading, lacks required disclosure, or could reasonably be mistaken for an authentic record or endorsement.

6. High-impact and professional uses

Outputs are not verified records and must not be used to make or support decisions about employment, housing, credit, insurance, education, immigration, law enforcement, legal rights, medical care, or other high-impact matters. Customer must not rely on an output as professional, legal, medical, financial, safety, identity, or authenticity advice. Customer must independently review every output before use.

7. API Credits, prices, and payment

API Credits are prepaid service units used only for the project to which they are credited. Unless a checkout states otherwise, 1 USD purchases 100 API Credits, the minimum top-up is 100 USD, the maximum top-up is 10,000 USD, and a top-up may contain no more than two decimal places. API Credits are not money, stored value, cryptocurrency, or a transferable asset; they have no cash value and cannot be resold or transferred between customers or projects.

Applicable prices and estimated Credit charges are shown in the Developer Hub or API response. Actual charges may depend on the selected model and completed work. Payment processing and refunds are subject to the payment provider, the displayed checkout terms, the ClearCrowds Refund Policy, and mandatory law. Taxes, duties, and bank, network, gas, or conversion fees are Customer’s responsibility unless the checkout states otherwise.

8. Outputs and third-party services

AI outputs are probabilistic and may be inaccurate, incomplete, offensive, unsafe, non-unique, or unsuitable. Similar or identical outputs may be provided to other customers. ClearCrowds does not grant rights in third-party material that may appear in an output and does not guarantee that an output is free of third-party claims.

The API Services rely on third-party model, hosting, storage, payment, blockchain, and network providers. Their availability and behavior may change. Customer is responsible for reviewing outputs and maintaining backups and recovery procedures appropriate to its use case.

ClearCrowds may use automated systems, provider-side moderation, abuse signals, and human review to prevent misuse and enforce these API Terms. We may refuse or stop a request, quarantine or remove content, disable output delivery or sharing, preserve relevant records, revoke credentials, suspend or terminate access, reverse improperly obtained entitlements, and report or disclose information when reasonably necessary to comply with law, protect people or the service, or respond to valid legal process.

Customer must cooperate with reasonable investigations and promptly stop any use that ClearCrowds identifies as unsafe or prohibited. Enforcement does not create a duty to pre-screen every request and does not transfer Customer’s responsibility to ClearCrowds.

10. Customer responsibility; no endorsement

Customer determines what to submit, what instructions to give, and whether and how to use an output. Customer Content, instructions, outputs, and downstream uses are Customer’s independent conduct; they are not statements, endorsements, approvals, representations, or instructions of ClearCrowds. Customer is responsible for notices, consents, disclosures, labels, human review, and legal compliance required for its use.

This allocation of responsibility does not exclude any duty or liability that applicable law imposes on ClearCrowds and does not prevent ClearCrowds from taking safety, moderation, or compliance measures.

11. Suspension and termination

Customer may stop using the API Services at any time. ClearCrowds may limit, suspend, or terminate access immediately for a material or repeated breach, security risk, non-payment, suspected fraud or illegal activity, threat to people or systems, provider restriction, or legal requirement. Sections that by their nature should survive—including payment obligations, ownership, responsibility, disclaimers, liability limits, indemnity, and records—survive termination.

12. Disclaimers

To the maximum extent permitted by law, the API Services and outputs are provided “as is” and “as available.” ClearCrowds disclaims implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, non-infringement, accuracy, uninterrupted availability, and error-free operation. Customer assumes the risk of integrating and using the API Services and outputs.

Nothing in these API Terms limits warranties, remedies, or consumer rights that cannot lawfully be excluded.

13. Limitation of liability

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, exemplary, punitive, or consequential loss, or for lost profits, revenue, goodwill, business opportunity, anticipated savings, or data, arising from the API Services, even if advised of the possibility. To the maximum extent permitted by law, ClearCrowds’ aggregate liability arising from the API Services will not exceed the amount Customer paid ClearCrowds for the API Services during the 12 months before the event giving rise to the claim.

These limitations do not apply where prohibited by law and do not exclude or limit liability for fraud, fraudulent misrepresentation, willful misconduct, gross negligence where it cannot be limited, death or personal injury caused by negligence where it cannot be limited, or any other non-waivable liability.

14. Indemnity

To the maximum extent permitted by law, Customer will defend, indemnify, and hold harmless ClearCrowds and its affiliates, personnel, and service providers from third-party claims, regulatory proceedings, losses, damages, judgments, penalties, and reasonable legal costs arising from Customer Content, Customer’s or its users’ use or distribution of outputs, violation of these API Terms, violation of law, or infringement of another person’s rights. This section does not apply to a consumer to the extent prohibited by applicable consumer law or to the extent a claim was caused by ClearCrowds’ own breach, gross negligence, or willful misconduct.

15. Changes, order of terms, and severability

ClearCrowds may update these API Terms to reflect legal, security, technical, or product changes. Material changes will be posted with a new effective date and, where required, notice. Continued use after the effective date constitutes acceptance to the extent permitted by law. If a signed order form conflicts with these API Terms, the signed order form controls for that conflict. If any provision is unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions remain effective.
